Jennifer Gross, R-West Chester, sees her recently filed proposal with Rep. Michelle Teska, R-Centerville, as a way to ensure that voice is heard.” “Under the bill, in order to construct a new data center or expand an existing one, the project must be approved by voters in municipalities 5 miles away from the project area (HB 983.)” “I think it's more balanced to say, ‘Let's give communities and the people a voice,’” she said in an interview. “Or the people are going to come back and say, ‘Then forget it, it's a complete moratorium,’ and I don't think that's a win-win.” “Gross is working with Ohio Advocates for Medical Freedom, which wrote the language.” “OAMF President Stephanie Stock said the plan also creates penalties for data centers that exceed discharge or emissions limits and bars any emergency order, administrative action or development agreement from preventing the public vote. Stock, who was defeated in the primary election in her bid to join the House, previously called on lawmakers to bar data centers from using water cooling and require such projects to be approved at the ballot by voters living within a 5-mile radius of a proposed facility.” “Unfortunately, many of the elected officials are taking matters into their own hands, and they are not actually listening to the citizens,” Stock said in an interview. “That's why getting citizen approval first, we believe, is an important pathway forward to ensure that every local citizen, in fact, is being heard.” “Gross emphasized that protections are needed to make sure that “we're not putting things into our water that could be harming the people drinking the water.” “If it's approved by the EPA, and the EPA says they're following standards, I'm OK with that,” she said. “The challenge is that if they're adding new things into the water that the EPA never tested for like forever chemicals, like PFAS, like glyphosate.” “If those things are not already removed, and even if they are, if they're adding more to the system and it's overwhelming our water processing, then we need to work with our water processing plants and be sure that they can handle it.” “Gross said she hopes the Legislature will also pick up HB983 in November, but added she does not expect the bill to advance this GA given the relatively small window of time left to move new legislation.” “Getting the conversation going for sure, helping people understand we are listening, I think, is very important,” she said.”

Jennifer Gross, a Butler County Republican, said.” “The sharpest disagreements center on who gets to decide where data centers are built. HB 983 would require a public vote before local officials could approve a new or expanded data center. Everyone living within five miles of the project would get a vote. She argued taxpayers shouldn’t have to pay to upgrade those systems if the federal government tightens water quality standards in the future. Instead, she said, the companies generating the wastewater should bear those costs.” “I would love to see this pass during lame duck,” she said. “This is a huge issue for Ohio citizens, and it absolutely needs to be addressed as quickly as possible. If we want Ohio to remain open for business to data centers, then we need to give the citizens a voice in the process.”

The “Data Center Accountability and Citizen Protection Act”: 1. Requires a citizen ballot vote before any data center or associated power facility expecting 1 megawatt of electrical load can be approved to be built in a city, village, or township locatedwithin 5 miles of the perimeter of the proposed facility. 2. Requires the Ohio EPA to set air emissions and wastewater safety standards for all non- regulated metals, glycols, and organics, including PFAS (forever chemicals), that are used in data centers and their power generating facilities. 3. Requires all new voter-approved data centers to use closed-loop cooling systems, and build their own power facility to maintain energy independence off the grid. 4. Requires all new voter-approved data centers to build an attached water treatment facilities with the capacity to treat the entire volume of discharge wastewater they produceprior to discharge’ 5. Requires all existing data centers to build attached water treatment facilities with the capacity to clean whatever amount of discharge waste water they produce within 18 months of the act going into effect. 6. Requires all existing data centers and associated power Facilities to comply with newly established air emissions standards within 18 months of the act going into effect. 7. Establishes daily penalties to be paid to the locally affected city, village, or township by a datacenter that violates emissions and wastewater discharge requirements, and sets a 30 30-daylimit to come into compliance or the data center is subject to removal of their license to operate. 8. Prohibits all property tax abatements 9. Prohibits future and currently allowed NDA’s for development and supply agreements related to data center or associated power-generating facility and protects local officials from being penalized for disclosing information about any such agreements. 10. Prohibits any person who participated in drafting or revising Ohio Power Siting Board rules or public utilities commission rules from representing a data center applicant for 3 years.
