  • In the name of Allah, the Most Gracious, the Most Merciful Fatwa No. ( 60 ) 📩 Question: Is it true that striking one's wife with a tooth-stick (*Siwak*) constitutes mockery of religion? 📝 The answer: It does not necessarily follow from the mere act of striking that he is mocking the religion. The *Siwak* is something beloved by Allah (سبحانه وتعالى), as reported in *Musnad Ahmad* and elsewhere from Aisha (رضي الله عنها) that the Prophet (ﷺ) said: «السِّوَاكُ مَطْهَرَةٌ لِلْفَمِ مَرْضَاةٌ لِلرَّبِّ» *"The Siwak is a means of purification for the mouth and pleasing to the Lord."* However, whoever strikes with it without indicating mockery is not considered to be mocking the religion in the act itself. But if contextual indicators (*Qara'in*) appear from him showing that he is indeed mocking with it, then it takes another legal ruling. Nevertheless, the base act of striking with it is not considered mockery of religion. Guidance Regarding Marital Conduct: Regarding striking the wife: * A Muslim should not rush into this matter. * One must follow the prescribed Islamic steps: good and gentle speech, kindness, and admonition (*Wa'dh*), just as Allah (عز وجل) began with admonition. Allah Almighty says: ﴿وَاللَّاتِي تَخَافُونَ نُشُوزَهُنَّ فَعِظُوهُنَّ وَاهْجُرُوهُنَّ فِي الْمَضَاجِعِ وَاضْرِبُوهُنَّ ۖ فَإِنْ أَطَعْنَكُمْ فَلَا تَبْغُوا عَلَيْهِنَّ سَبِيلًا﴾ [النساء: 34] *"As to those women on whose part you fear disloyalty and ill-conduct, admonish them [first], [next] refuse to share their beds, [and last] strike them [lightly]; but if they return to obedience, seek not against them means [of annoyance]."* [An-Nisa: 34] * If you are in a country where the societal custom (*'Urf*) is that a man does not strike his wife, but rather complains about her conduct to her family you must abide by that custom and you have no right to strike her. This is because custom carries the weight of a condition (*Al-'Urf ka-al-Shart*).   • Fifthly: The approach and method of the scholars towards an innovator is to wait for a period of time, during which he is observed and monitored, until his repentance becomes sound and his condition is rectified. His repentance is not immediately accepted and he is not simply taken at his word. Shaykh al-Islām Ibn Taymiyyah said: “The jurists stipulated, according to one of their two positions, regarding the acceptance of the testimony of the one who has been accused of slander, that he become upright, and they estimated this to be one year, just as ʿUmar dealt with Ṣabīgh ibn ʿAsal when he deferred him for one year. Aḥmad adopted this same position regarding the repentance of one who calls to innovation: that he is deferred for one year, just as ʿUmar deferred Ṣabīgh ibn ʿAsal”… Shaykh al-Islām Ibn Taymiyyah also said: “…ʿUmar, may Allāh be pleased with him, commanded the Muslims to boycott Ṣabīgh ibn ʿAsal al-Tamīmī when he saw him to be among those who followed the ambiguous passages of the Book, until a year had passed and the sincerity of his repentance became apparent, after which he commanded the Muslims to resume relations with him…”… Ṣiyānat al-Salafī min Waswasah wa Talbīsāt ʿAlī al-Ḥalabī, pp. 481–487.   • What Should a Person Do When Thoughts That Undermine His Creed Occur to Him? Shaykh Muhammad ibn Salih al-Uthaymeen, may Allah have mercy upon him, said: But if thoughts occur within the soul concerning matters that undermine one’s creed, what should a person do? This is because Shayṭān gains influence over the believer whose faith is genuine in order to corrupt his faith and cast doubts into it. The answer is that the remedy consists of two instructions clarified by the Prophet ﷺ: The first: Seek refuge with Allah from Shayṭān, the accursed. So seek refuge with Allah, and imagine yourself as though you are fleeing from an enemy and seeking protection with a guardian. It should not merely be that you say, “I seek refuge with Allah (اعوذ بالله),” with your tongue. Rather, imagine yourself fleeing from an enemy to a protector who takes care of you and shields you from that enemy. This is a positive remedy. The second: This is a preventative remedy: stop and turn away from these thoughts. Do not allow them to occupy your mind. Busy yourself with something else. Even if you have to take a spade and cultivate the earth, then do so. This is because when you occupy yourself with an activity, it causes you to become distracted from the whisperings within your heart. There is no doubt that a person is always striving and intending; when he turns his attention towards one matter, he forgets another. Therefore, turn away from these thoughts. For this reason, the Prophet ﷺ said: “Let him stop.” Thus, do whatever will cause you to stop thinking about these matters and turn away from them. 📚Taʿlīq ʿalā Ṣaḥīḥ Muslim (1/375).

  • In the name of Allah, the Most Gracious, the Most Merciful 📩 Question ( 32 ): What is the legal cause (reason) behind the prohibition of chess? 📝 The answer: Chess is among the greatest distractions; it distracts from the remembrance of Allah and from prayer. Additionally, it contains carved statues, and images are prohibited and among the major sins, especially when they are carved, making the reason even stronger and its prohibition even greater than other forms. Furthermore, as previously mentioned, it distracts from the remembrance of Allah because the player spends a significant amount of time playing it while being heedless of Allah’s remembrance, losing much time in this game. It has been authentically reported from Ali ibn Abi Talib (may Allah be pleased with him) through routes that strengthen one another that he denounced this game and those who play it. It is an ancient game, and he recited to them the statement of Allah Almighty: "مَا هَٰذِهِ التَّمَاثِيلُ الَّتِي أَنتُمْ لَهَا عَاكِفُونَ" [الأنبياء: 52] "What are these statues to which you are devoted?" [Al-Anbiya: 52] And it has been authentically reported from all the Successors (Tabi'un) that they warned against it. Allah, Exalted and Majestic, said: "إِنَّمَا يُرِيدُ الشَّيْطَانُ أَن يُوقِعَ بَيْنَكُمُ الْعَدَاوَةَ وَالْبَغْضَاءَ فِي الْخَمْرِ وَالْمَيْسِرِ وَيَصُدَّكُمْ عَن ذِكْرِ اللَّهِ وَعَنِ الصَّلَاةِ ۖ فَهَلْ أَنتُمْ مُنتَهُونَ" [المائدة: 91] "Satan only wants to cause between you animosity and hatred through intoxicants and gambling and to avert you from the remembrance of Allah and from prayer. So will you not desist?" [Al-Ma'idah: 91] This is among the things that avert from the remembrance of Allah and from prayer. Moreover, if it is played for money, it becomes gambling (Maysir), whether from both parties or one party—such as one risking this money while the winner takes it, or both paying money and the loser losing his money—making its sin even greater, as it falls under gambling and constitutes a major sin. By extension, games on mobile phones, tablets, computers, and the like that contain images are undoubtedly prohibited due to the presence of images—meaning images of living beings (An-Nufus). If a game does not contain images, but distracts from the remembrance of Allah and wastes time, it is not permissible for a mature Muslim to waste his time on it. However, there is no harm in using them to entertain children, because Islamic law has permitted play for children, and such entertainment has leniency in Sharia. It might also be better than going out into the streets and mixing with corrupt people. But parents must regulate this so that children do not fall into prohibited matters without the father knowing. Unknowingly, they might watch content with images, music, musical instruments, TV series, or inappropriate depictions of women. Likewise, wasting time in this manner must be regulated by parents; they should give them access only at a specific time and then take it away from them. Similarly, dominoes (Ad-Dumnah) fall under the same ruling regarding adults: it distracts from the remembrance of Allah and prayer and causes time to be wasted. The Prophet (ﷺ) said: "لَا تَزُولُ قَدَمَا عَبْدٍ يَوْمَ الْقِيَامَةِ حَتَّى يُسْأَلَ عَنْ أَرْبَعٍ: عَنْ عُمُرِهِ فِيمَا أَفْنَاهُ..." "The feet of a servant will not move on the Day of Resurrection until he is asked about four things: about his lifespan and how he spent it..." Children—as previously stated—we have no evidence preventing them from this, but the guardian must regulate this matter. This applies if it is without gambling; however, if it involves gambling, it is strictly prohibited (Haram). All distractors and games are not permissible for adults to play because they waste time. The Prophet (ﷺ) said: "نِعْمَتَانِ مَغْبُونٌ فِيهِمَا كَثِيرٌ مِنَ النَّاسِ: الصِّحَّةُ وَالْفَرَاغُ" "There are two blessings in which many people are deceived: health and free time."

  • The Reality of Worshipping Graves and Seeking Intercession Through the Dead Shaykh al-Muftī Ṣāliḥ al-Fawzān, may Allah preserve him, said: Regrettably, today in some lands, graves have been taken as idols that are worshipped besides Allah by people who claim to be Muslims. One of them may even call upon other than Allah in any place, even if he is not at a grave, such as one who says, “O Messenger of Allah!” when he stands up or is suddenly confronted by something astonishing, or he says, “Help (al-madad), O Messenger of Allah!” or “O so-and-so!” When they are forbidden from doing this, they say: “We know that these people have no power over anything, but they are righteous people who have status with Allah, and we seek through their status and their intercession.” These people have forgotten—or pretend to have forgotten—while they recite the Qur’an, that this is precisely the statement of the polytheists which Allah mentioned in the Qur’an, in His statement, the Exalted: “And they worship besides Allah that which neither harms them nor benefits them, and they say: ‘These are our intercessors with Allah.’ Say: ‘Do you inform Allah of something He does not know in the heavens or on the earth?’ Glorified and Exalted is He above whatever they associate with Him.” (Sūrah Yūnus 10:18) And His statement, the Exalted: “Unquestionably, for Allah alone is the pure religion. And those who take protectors besides Him say: ‘We only worship them so that they may bring us nearer to Allah in position.’ Indeed, Allah will judge between them concerning that over which they differ. Indeed, Allah does not guide one who is a liar and a disbeliever.” (Sūrah az-Zumar 39:3) Thus, Allah described them as disbelievers and liars, even though they believed that these righteous people were merely intermediaries between themselves and Allah in the fulfilment of their needs. This is exactly what the worshippers of graves say today: “Their hearts are alike.” (Sūrah al-Baqarah 2:118) 📚Al-Irshād ilā Ṣaḥīḥ al-Iʿtiqād wa ar-Radd ʿalā Ahl ash-Shirk wa al-Ilḥād, pp. 32–33.

  • The Ruling on Remaining in the Presence of Evil While Claiming to Reject It in One’s Heart Shaykh Muhammad ibn Salih al-Uthaymeen, may Allah have mercy upon him, said: If someone were to ask: Is it permissible for a person to remain among those committing an evil while saying that he rejects it in his heart? The answer is: No. This is because Allah, the Most High, said in His Book: ﴿وَقَدْ نَزَّلَ عَلَيْكُمْ فِي الْكِتَابِ أَنْ إِذَا سَمِعْتُمْ آيَاتِ اللَّهِ يُكْفَرُ بِهَا وَيُسْتَهْزَأُ بِهَا فَلَا تَقْعُدُوا مَعَهُمْ حَتَّى يَخُوضُوا فِي حَدِيثٍ غَيْرِهِ إِنَّكُمْ إِذًا مِثْلُهُمْ﴾ “And it has already been revealed to you in the Book that when you hear the verses of Allah being denied and mocked, then do not sit with them until they engage in a different conversation. Indeed, you would then be like them.” [Sūrah al-Nisāʾ: 140] The only exception is if he is compelled to remain with them, such as if they detain him by locking the doors, restraining his limbs, or if he fears that leaving will expose him to harm through imprisonment, beating, or something similar. Know that the purpose of denouncing evil is to lessen it or remove it. Therefore, if denouncing it will neither lessen nor remove it, then you have a choice. But if denouncing it will cause the evil to increase, then you are prohibited from denouncing it. 📚Taʿlīq ʿalā Ṣaḥīḥ Muslim (1/205).

  • In the name of Allah, the Most Gracious, the Most Merciful 📩 Question: The questioner asks: Some rationalists (*al-'Aqlaniyyun*) claim that the Hadith regarding the Prophet (ﷺ) being bewitched contradicts his infallibility (*'Ismah*)? 📝 The answer: This doubt is baseless, and the authentic Hadith regarding the Prophet (ﷺ) being bewitched—recorded in *Sahih al-Bukhari* and *Sahih Muslim* on the authority of 'A'ishah (رضي الله عنها)—does not in any way contradict his divine protection and infallibility (*'Ismah*). This can be understood through the following points: 1. Authenticity of the Report: The Hadith is at the highest level of authenticity, agreed upon by al-Bukhari and Muslim (*Muttafaq 'Alayh*). Rejecting authentic texts based on pure rational speculation opens a dangerous door to dismantling the Sunnah. 2. The Scope of the Magic's Effect: The magic that afflicted the Prophet (ﷺ) was a purely physical illness and temporary bodily condition. It only made him imagine that he had done a routine worldly action with his family when he had not (such as approaching his wives). It did not affect his intellect, his mind, his heart, his belief, or his conveyance of Allah's revelation (*al-Balagh*). 3. Nature of Infallibility (*al-'Ismah*): The infallibility (*'Ismah*) of the Prophets means they are completely protected by Allah from error, falsehood, or defect in receiving and conveying the Divine Message and Religion. It does not mean they are protected from ordinary human ailments, such as sickness, fever, wounds, pain, or physical harm. 4. Wisdom Behind Human Afflictions in Prophets: Prophets are human beings who experience ordinary physical human trials. Experiencing illness or physical effects of magic highlights their complete humanity—showing they are not divine—and serves to elevate their status, increase their reward through patience, and provide an example for their nation on how to seek treatment and rely on Allah through Ruqyah and supplication.   • Advice for a Young Man at the Beginning of His Journey of Steadfastness Shaykh Muhammad ibn Salih al-Uthaymeen, may Allah have mercy upon him, was asked: What advice would you give to a young man who is at the beginning of his journey of steadfastness upon Islam? He replied: Our advice to this young man, who is upon a sound path, inshā’Allāh, is: First: That he constantly asks Allah for steadfastness and correctness. Second: That he frequently recites the Qur’an with reflection and contemplation, for this Qur’an has a tremendous effect upon the heart when a person reads it thoughtfully. Third: That he strives to remain constant in acts of obedience and does not become weary or lazy, for the Prophet ﷺ sought refuge from incapacity and laziness. Fourth: That he is keen to accompany righteous people and keeps away from the company of evil people. Fifth: That he advises and encourages himself whenever his soul begins to affect him and says, “The distance is long, and the path is difficult.” Let him counsel himself and remain firm, for Paradise is surrounded by hardships, while the Fire is surrounded by desires and temptations. Sixth: That he distances himself from bad companions, even if they were his friends in the past, because evil companions have an effect upon a person. For this reason, the Prophet ﷺ said: “The example of a bad companion is like the blacksmith’s bellows: either he will burn your clothes, or you will find from him an offensive smell.” 📚Liqāʾ al-Bāb al-Maftūḥ (70/33).

We affirm (for Allāh) what has been affirmed in the Qur'ān and the authentic Sunnah (i.e., prophetic narrations) and what the Ummah agreed upon [which is that Allāh has] risen above the Throne, in a way which befits His Majesty. And as for [affirming the attribute of Allāh] sitting, then there's no authentic Hadith (prophetic narration) concerning it, nor has sitting been mentioned in the Qur'ān, nor in the Sunnah. There is a weak Hadīth which has been narrated from some of the Salaf as-Ṣālih (righteous predecessors) - weak narrations - one narration from Mujāhid and one narration from the path of Khārijah ibn Muṣ'ab as-Sarkhasī and he is Matrūk (i.e., his narrations are not to be taken). Hence, we don't ever affirm the expressions "sitting up" or "sitting down" (for Allāh), nor do we negate it. We don't affirm it, nor [negate it] because the Qur'ān and the Sunnah didn't affirm it, and we don't negate it because the Qur'ān and Sunnah didn't negate it. So we keep silent about [the attribute of] sitting up and sitting down in terms of affirming and negating it, and we affirm al-Istiwā (rising above the Throne) and al-'Uluww (Loftiness) for Allāh in a way that suits His Majesty.
