Metropolitan Police officer Michael Fanone has been criminally referred to the DOJ by @IvanRaiklin (Ivan Raiklin) over allegations tied to his January 6 testimony, public statements, and conduct during a House Judiciary Committee hearing. To be clear: a criminal referral is not a criminal charge. The DOJ has not confirmed that Fanone has been indicted, charged, or that any active prosecution has begun. But the referral raises serious questions. According to Raiklin, the referral was submitted to Acting Attorney General Todd Blanche, with a copy referred to D.C. U.S. Attorney Jeanine Pirro, and alleges possible violations involving: 🔷 False statements to Congress 🔷 Obstruction of official proceedings 🔷 Assaulting or impeding officers or employees 🔷 Unlawful activity on Capitol grounds Raiklin also says he filed a separate $10 million civil lawsuit against Fanone that includes claims for defamation, assault, and threats. The center of the controversy is Fanone’s past description of what happened to him on January 6, including his claim that he was beaten unconscious for more than four minutes, suffered a heart attack, and was later diagnosed with a concussion, traumatic brain injury, and PTSD. Critics argue that bodycam and EMT footage raise questions about parts of that timeline, including whether Fanone was conscious and speaking shortly after being pulled from the crowd. Supporters of Fanone point to the violence he faced on January 6 and the fact that people were convicted for assaulting him. That is exactly why the evidence matters. This should not be about protecting a narrative. It should be about applying the same legal standard to everyone. If people were prosecuted based on statements, videos, testimony, and timelines, then public officials, witnesses, activists, and media figures should be held to the same standard when their own claims are challenged. A referral is not proof of guilt. But it is a demand for investigation. The currently untitled film will follow the early life of a cop who goes on to be caught up in the January 6th Capitol riots. Penn has scripted and will direct the movie, which has five-time Oscar nominated actor Bradley Cooper in talks to star in the lead role. There’s no deal yet. The film will re-team Penn with One Battle After Another studio Warner Bros, which has acquired it in a negative pickup. Penn will produce with John Ira Palmer and John Wildermuth under their Projected Picture Works banner. CAA Media Finance negotiated the WB deal on behalf of the producers. Production is being targeted for mid-2027 given Cooper’s commitments on the next Oceans film. The project has been described to us as an unexpected story about friendship. But it will function on multiple levels. Based on one of the real-life cops caught up in the Capitol attack, the project is understood to have buy-in from its subject, however their identity is being kept under wraps for now. We’re told the focus is on the subject’s early journey, one that led to him later becoming an American hero in the eyes of many. It’s not a ‘January 6th movie’ per se. Nonetheless, given the still divisive terrain, the political climate, and the studio’s potential new owners, it’s a commendable commitment by Warner Bros, which has had big success recently with bold original stories. I am a J6er. I protested a stolen election.  Walked right past the police through an open door, and the police let me in. My father's step son turned me into the FBI.  My house was raided. They branded me a traitor, and insurrectionist, slapped me on a terrorist watchlist.  I plead guilty to illegal picketing, a Class B petty offense misdemeanor with the same sentencing guidelines as walking your dog off leash on a National Park . They swore no prison time. They lied. Judge Hogan sentenced me to 30 days for “not being remorseful enough” and three years’ probation to tie me up through elections.  An unconstitutional "split" sentence.  My Judge, Judge Hogan called J6 worse than the war of 1812. Enrique Tarrio, the Proud Boys leader sentenced ‌to 22 years for seditious conspiracy over the January 6, 2021 riot, said he planned to apply to the fund, assuming he could get between $2 and $5 million. "I'm not greedy," Tarrio said. "But my life was all fucked up because of this." Trump pardoned more than 1,500 January 6 defendants last year. Some have now begun to calculate the cost of their prosecution, jail time and businesses lost in the hope of compensation for ​what they regard as abuses by the Justice Department under former President Joe Biden. Peter Ticktin, an attorney representing more than 400 January 6 defendants, said the fund ​may not be enough. "People lost multi-million dollar businesses while they were locked up," he said. "I don’t think the DOJ is ready for us ⁠yet." Trump also suggested the fund may be too small. "You're talking about peanuts," he told reporters at Joint Base Andrews. "It destroyed the lives of many, many people."
