🇨🇷 COSTA RICA - VASP REGULATORY CHANGES Costa Rica's Legislative Assembly unanimously passed Legislative Decree No. 10961, amending Law No. 7786 (the AML/CFT Law) to incorporate Virtual Asset Service Providers as obligated subjects for the first time. 📋 WHAT CHANGED: VASPs must now register with SUGEF (Superintendencia General de Entidades Financieras) for AML/CFT supervision. The law introduces formal legal definitions of "virtual asset" and "VASP" covering exchange, transfer, custody, financial services related to issuance, offering, and commercialization of virtual assets. ⚠️ CRITICAL DISTINCTION: Registration ≠ Operating license. The law is explicit — SUGEF registration does not constitute an authorization or permit to operate. Costa Rica still has no formal VASP operating license. BUT — financial institutions are now restricted from serving VASPs that fail to register when required. In practice, registration is becoming a banking access gatekeeper. 📌 MANDATORY AML/CFT OBLIGATIONS NOW IN FORCE: - Customer identification and beneficial owner verification (KYC/CDD) - Transaction records maintained and available on request - Enhanced controls for Politically Exposed Persons (PEPs) - Risk assessment for new products, services, and technologies - Controls over virtual asset transfers (Travel Rule) - Suspicious transaction reporting to the FIU (UIF) of the ICD 💰 PENALTIES for non-compliance: USD $1,800–$90,000 per violation or 5–50% of the transaction value. ⏳ STATUS: Passed — awaiting presidential signature. After publication in La Gaceta, CONASSIF has 3 months to issue implementing regulations defining thresholds, supervision criteria, and practical obligations. 🔑 BOTTOM LINE: Costa Rica remains a jurisdiction without a formal VASP license. The new fee schedule came into effect on 1 July 2026. 🚨 CySEC Confirms the End of the MiCA Transitional Period The Cyprus Securities and Exchange Commission (CySEC) has officially notified market participants that the MiCA transitional period expired on 1 July 2026. What this means: • Only MiCA-authorised Crypto-Asset Service Providers (CASPs) may now legally provide crypto-asset services in or into Cyprus. • Firms operating under previous national transitional arrangements must cease providing crypto-asset services unless they have obtained MiCA authorisation. • According to ESMA's guidance, non-authorised firms should: ✔️ Stop onboarding new clients; ✔️ Cease all marketing and promotional activities; ✔️ Wind down existing business in an orderly manner; and ✔️ Inform clients about the discontinuation of services. This marks another important milestone in the full implementation of MiCA across the European Union and reinforces the importance of obtaining a CASP licence for firms wishing to continue serving the EU crypto market. 🚨 Interesting development from Saxo Bank Saxo is updating its funding rules citing compliance requirements. From 1 July 2026, clients will only be able to deposit from and withdraw to bank accounts in their country of residence. From 22 July 2026, transfers to/from foreign bank accounts will no longer be accepted. Would this kill the client base of Saxo? For 2026 with all of the migration, expats, Revolut, and other neo-banks - having such a limitation seems something out of 1990s.

Mauritius FSC Introduces New Authorised Bank Signatory Regime for GBCs The Financial Services Commission (FSC) Mauritius has announced a new regulatory requirement affecting all licensed Global Business Corporations (GBCs). 📌 What’s changing? Under the updated Guidelines for Management Companies, each bank account operated by a GBC must have at least one authorised signatory who is an officer of the Management Company. This officer may be: ✅ A resident director appointed under the Financial Services Act; or ✅ An approved officer of the Management Company. 📅 Effective Date: 19 June 2026 ⏳ Transition Period: Existing GBCs will have 3 months from the effective date to update their banking arrangements and ensure compliance. ⚠️ Failure to comply after the transition period may result in regulatory action by the FSC.
