*Making Vande Mataram Legally Mandatory Is an Attack on Religious and Constitutional Freedom:* All India Muslim Personal Law Board https://www.facebook.com/share/p/14hJtxv4HP4/ ------------------------------------------ New Delhi, 31 July 2026: The All India Muslim Personal Law Board has expressed grave concern over the passage of an Amendment Bill by both Houses of Parliament making alleged disrespect to Vande Mataram a punishable offence. The Board has termed the move contrary to the constitutional, secular and democratic ethos of the country and a serious assault on the religious freedom of citizens. According to the Board, seeking through legislation to impose a particular religious concept or belief upon all citizens is inconsistent with the basic spirit of the Constitution of India. In a statement, Dr. S. Q. R. Ilyas, Spokesperson of the All India Muslim Personal Law Board, said that any attempt to make Vande Mataram compulsory for all sections and religious communities through legal coercion is not only objectionable but also contrary to the fundamental principles of the Constitution. He pointed out that, during the framing of the Constitution, the Constituent Assembly, after detailed deliberation, accepted only the first two stanzas of Vande Mataram at the national level, while the religious connotations of its other portions were not considered compatible with the secular character of the country. Dr. Ilyas said that certain passages of Vande Mataram are based on religious concepts in which the motherland is depicted in the form of a goddess and people are exhorted to worship her. Such a concept is unequivocally contrary to the fundamental Islamic doctrine of Tawheed, or the absolute Oneness of God. He made it clear that a Muslim worships only Allah, the One and the Only God, and that associating any partner with Him in His Being, Attributes, rights or authority is incompatible with Islamic faith. Therefore, compelling a Muslim to participate in a song, slogan or practice carrying a religious meaning contrary to his or her faith is wholly unacceptable. He said that Article 25 of the Constitution of India guarantees every citizen the freedom to profess, practise and follow his or her religion, while Article 19 guarantees freedom of expression. These constitutional safeguards clearly imply that no citizen can be compelled to adopt or participate in any song, slogan, ideology or symbol against his or her religious beliefs and conscience. Referring to the Supreme Court’s landmark judgment in Bijoe Emmanuel v. State of Kerala, the Spokesperson said that the Court had upheld this principle even in the context of the national anthem, Jana Gana Mana. The Court held that a person could not be punished merely for not participating in an act when doing so was contrary to his or her religious beliefs. The Court also made it clear that, in certain circumstances, freedom of expression includes the right to remain silent, and that respectful non-participation cannot be regarded as disrespect. Dr. Ilyas emphasised that love for the motherland and worship of the motherland are two entirely different concepts. Muslims deeply love their country and consider love for the homeland part of their civic and moral responsibility, but they cannot regard the country as a deity or goddess. He said that patriotism should not be measured by the recitation of any particular slogan or song; rather, it should be judged by one’s commitment to the country, its Constitution, its people and their rights. He urged the government to focus instead on resolving the real problems confronting the country—unemployment, inflation, poverty, education, healthcare, economic inequality and social injustice—rather than pursuing sensitive and divisive measures. Diverting public attention from fundamental issues by inflaming emotional and religious controversies serves neither the national interest nor the cause of democracy.

ایک، قبلہ ایک اور دین ایک ہے۔ اسی حقیقت کو واضح کرتے ہوئے انہوں نے نہایت مؤثر انداز میں علامہ اقبالؒ کے یہ اشعار نقل کیے ہیں: منفعت ایک ہے اس قوم کی، نقصان بھی ایک ایک ہی سب کا نبی، دین بھی، ایمان بھی ایک حرمِ پاک بھی، اللہ بھی، قرآن بھی ایک کیا بڑی بات تھی ہوتے جو مسلمان بھی ایک یہ پیغام دراصل آل انڈیا مسلم پرسنل لا بورڈ کے ہر دور کی قیادت کا مشترکہ پیغام بھی ہے کہ تحفظِ شریعت کا راستہ اتحادِ ملت سے ہو کر گزرتا ہے، اور اختلافات سے بالاتر ہو کر اجتماعی مفاد کو مقدم رکھنا ہی وقت کا سب سے بڑا تقاضا ہے۔ موجودہ حالات اور ملت کی اجتماعی ذمہ داری ملتِ اسلامیہ ہند اس وقت اپنی تاریخ کے ایک نہایت نازک اور فیصلہ کن دور سے گزر رہی ہے۔ ایک طرف مذہبی آزادی، اسلامی تشخص اور دستوری حقوق سے متعلق نئے نئے چیلنج سامنے آرہے ہیں، تو دوسری جانب مسلمانوں کے عائلی قوانین، اوقاف اور مذہبی اداروں سے متعلق ایسے معاملات پیدا ہورہے ہیں جن کا مقابلہ صرف قانونی جدوجہد سے نہیں بلکہ مضبوط ملی اتحاد، اجتماعی بصیرت اور منظم حکمتِ عملی سے کیا جاسکتا ہے۔ ایسے حالات میں آل انڈیا مسلم پرسنل لا بورڈ کی ذمہ داری پہلے سے کہیں زیادہ بڑھ جاتی ہے، کیونکہ یہ صرف ایک تنظیم نہیں بلکہ ملت کے مشترکہ شعور، اجتماعی فکر اور تحفظِ شریعت کی نمائندہ آواز ہے۔ اس ادارے کی قوت اس کے دستور میں نہیں بلکہ اس اتحاد میں ہے جس نے نصف صدی سے زیادہ عرصہ تک مختلف مکاتبِ فکر کو ایک مرکز پر جمع رکھا ہے۔ تیسواں اجلاس عام — وقت کی ایک اہم ضرورت اسی پس منظر میں آل انڈیا مسلم پرسنل لا بورڈ کا تیسواں سالانہ اجلاس 2 تا 4 اکتوبر 2026ء، احمد آباد (گجرات) میں منعقد ہونے جارہا ہے۔ اس اجلاس میں بورڈ کے اراکین، مختلف دینی و ملی اداروں کے ذمہ داران، اکابر علماء اور مدعو شخصیات شریک ہوں گی تاکہ ملت کو درپیش اہم مسائل پر غور کیا جاسکے۔ خصوصی طور پر وقف (ترمیمی) قانون، یونیفارم سول کوڈ (UCC) اور مسلمانوں کے مذہبی و دستوری حقوق سے متعلق امور اس اجلاس کے اہم موضوعات ہوں گے۔ ایسے وقت میں یہ اجتماع صرف ایک تنظیمی اجلاس نہیں بلکہ ملت کے اجتماعی ضمیر کی آواز، فکری رہنمائی اور آئندہ کے لائحۂ عمل کی تشکیل کا ایک اہم سنگِ میل ثابت ہوسکتا ہے۔ وقت کا سب سے بڑا تقاضا تاریخ شاہد ہے کہ جب بھی مسلمان اپنے داخلی اختلافات سے بلند ہوکر ایک صف میں کھڑے ہوئے، اللہ تعالیٰ نے انہیں عزت، وقار اور کامیابی عطا فرمائی، اور جب وہ گروہوں، جماعتوں اور مسلکی نزاعات میں الجھے تو ان کی اجتماعی قوت کمزور پڑگئی۔ آج بھی ضرورت اس بات کی ہے کہ اختلافات کو اختلاف ہی کی حد تک رکھا جائے اور مشترکہ دینی و ملی مفادات کو سب سے مقدم سمجھا جائے۔ تحفظِ شریعت، اوقاف کی حفاظت، دینی شناخت کی بقا اور آئینی حقوق کے دفاع جیسے مسائل کسی ایک جماعت یا مسلک کے نہیں بلکہ پوری ملت کے مشترکہ مسائل ہیں۔ آل انڈیا مسلم پرسنل لا بورڈ کی نصف صدی سے زیادہ کی تاریخ یہی سبق دیتی ہے کہ اجتماعیت ہی قوت ہے، اتحاد ہی بقا ہے اور مشترکہ جدوجہد ہی کامیابی کا راستہ ہے۔ صدورِ بورڈ کا مشترکہ پیغام اگر بورڈ کی پوری تاریخ پر نگاہ ڈالی جائے تو ایک حقیقت روزِ روشن کی طرح سامنے آتی ہے کہ اس کے تمام صدورِ کرام نے، خواہ وہ حضرت مولانا قاری محمد طیبؒ ہوں، مفکرِ اسلام حضرت مولانا ابو الحسن علی ندویؒ، حضرت قاضی مجاہد الاسلام قاسمیؒ، حضرت مولانا سید محمد رابع حسنی ندویؒ یا موجودہ صدر حضرت مولانا خالد سیف اللہ رحمانی دامت برکاتہم، سب نے اپنے اپنے دور میں ایک ہی پیغام دیا: "اختلافات کو ہوا نہ دو، امت کو جوڑو؛ شخصیتوں کو نہیں، اجتماعیت کو مضبوط کرو؛ اور شریعتِ اسلامی کے تحفظ کے لیے سب کو ایک پلیٹ فارم پر جمع رکھو۔" یہی وہ فکر ہے جس نے آل انڈیا مسلم پرسنل لا بورڈ کو ہندوستان کی سب سے مؤثر، باوقار اور ہمہ گیر ملی تنظیم بنایا، اور یہی اس کے مستقبل کی کامیابی کی بھی ضمانت ہے۔ آج جبکہ ملتِ اسلامیہ ہند کو اتحاد، حکمت اور بصیرت کی پہلے سے کہیں زیادہ ضرورت ہے، ہر صاحبِ درد مسلمان کی ذمہ داری ہے کہ وہ اختلافات سے بالاتر ہوکر اپنے ملی اداروں کا تعاون کرے، اکابر علماء کی قیادت پر اعتماد رکھے اور تحفظِ شریعت کی اس مشترکہ جدوجہد میں اپنا کردار ادا کرے۔ قرآنِ کریم کی یہ ہدایت آج بھی ہماری کامیابی کا ابدی منشور ہے: «﴿وَاعْتَصِمُوا بِحَبْلِ اللَّهِ جَمِيعًا وَلَا تَفَرَّقُوا﴾» اور علامہ اقبالؒ کی یہ صدا آج بھی ہمارے ضمیر کو جھنجھوڑتی ہے: منفعت ایک ہے اس قوم کی، نقصان بھی ایک ایک ہی سب کا نبی، دین بھی، ایمان بھی ایک حرمِ پاک بھی، اللہ بھی، قرآن بھی ایک کیا بڑی بات تھی ہوتے جو مسلمان بھی ایک
