  • 🔆 In India, Voting Cannot Remain Merely a Statutory Right 📍 What is it? ✅ A constitutional debate on whether the Right to Vote should be elevated from a statutory right to a constitutional/fundamental democratic right. ✅ Although voting is governed by law, the Supreme Court has progressively recognized key voting-related rights under Article 19(1)(a). 📍 Current Status of Voting Rights ✅ Article 326 provides universal adult suffrage for Lok Sabha and State Assembly elections. ✅ Voting is regulated through the Representation of the People Acts, 1950 & 1951. ✅ Parliament prescribes qualifications, procedures, and disqualifications for voters. 📍 Why Should Voting Receive Stronger Constitutional Protection? ✅ Voting is the primary expression of popular sovereignty in a democracy. ✅ Democracy is part of the Basic Structure of the Constitution. ✅ Protects citizens from arbitrary deletion from electoral rolls. ✅ Removes the contradiction where NOTA is constitutionally protected but the right to choose a candidate is treated only as statutory. 📍 Important Supreme Court Judgments ✅ N.P.
