Why Fiqh Isn't Just Reading Directly from Sahih al-Bukhari: Understanding Usul al-Fiqh Shaykh Mutlaq al-Jasir حفظه الله says: Someone says: "Why did the ʼulama differ here? What is this contradiction? What is this conflict?" Then comes another person who does not study usul. He cherry picks an opinion from the Shafi'i here, and another opinion from the Hanbali there, even though both opinions are built on entirely different usul! For instance, he might view Hajj as being mandatory immediately ('ala al-fawr), yet view Zakat as being mandatory with flexibility ('ala al-tarukhi). What does that mean? Make up your mind! Do you believe that a command (al-amr) implies immediate obligation, or delayed obligation? If you believe a command implies delayed obligation, then all your furu' must strictly align with that. And if you believe a command implies immediate obligation, all your furuʼ must align with that as well. This is why, when you open books of the madhhabs , you find fuqaha within the same maddhab disputing each other. One will object to another, saying: "This contradicts the qawa'id! This doesn't work according to our madhhab's!" The other replies, "No, it does work." This is where you find deep fiqh, and anyone who doesn't understand these issues is deprived of them and their pleasures. Therefore, my brothers, the confusion occurring among some people regarding fatwas, the anomalous fatwas (shudhudh), and the lack of consistency in them, stems directly from a failure to master usul and al-qawa'id al-usuliyyah. This is how fiqh is produced. Fiqh isn't just opening Sahih al-Bukhari and saying, "The Messenger of Allah (ﷺ ) said such and such, so you must do this, brothers!" This matter isn't a game. It is built on qawaʼid, on usul, and on synthesizing general evidence (al-adillah al-ijmaliyyah) with specific evidence (al-adillah al-tafsiliyyah). General evidence has conditions and parameters that must be mastered alongside specific evidence, from which a hukm shar'i is derived. ʼUlama differ in their furu' based on their differences in usul or general adillah. For example, "Hajj is mandatory immediately" means that anyone who meets the conditions of Hajj and is capable is not permitted to delay Hajj to the following year; if he delays it, he sins. This is the view according to the Hanbalis. The Shafi'is, however, say no, it is not immediately mandatory. Why did they differ here? Here lies the fruit of studying usul: for the Shafi'is, a command does not inherently imply immediate execution. For the Hanbalis, a command does imply immediate execution. Of course, these usuli evidences or qawaʼid themselves are backed by proofs, detailed discussions, and khilaf, so the matter is not simple! [ شرح متن الورقات (4) ]

[Sahih al-Bukhari] * An eclipse occurred on the day Ibrahim, the son of the Prophet ﷺ, died. The people said the eclipse occurred due to the death of Ibrahim, in which the Prophet ﷺ replied… (see hadith above). 📌 Ruling: Sunnah Mua’kkadah, an emphasised Sunnah. It is best done in Jama’ah in a Masjid. ⏰ Timing: From the beginning of the eclipse until it has ended 🕌 Description: (2 long raka’at) 1️⃣ You begin your salah as normal, you recite Surah al-Fatiha 2️⃣ You recite a long Surah * * There is no specific surah to be read, but al-Iqna’ mentions Surah al-Baqarah or it’s equivalent, recited out loud 3️⃣ A long bowing 4️⃣ Rise from bowing 5️⃣ Recite سمع الله لمن حمدة وربنا ولك الحمد 6️⃣ You do not go into prostration at this point, rather you recite Fatiha and another long surah* * Not as long as the Surah recited in the first raka’ah 7️⃣ A bowing * * You do not lengthen it, as stated in al-Iqna’ 8️⃣ Then you rise from bowing 9️⃣ Recite سمع الله لمن حمدة وربنا ولك الحمد 1️⃣0️⃣ Then you prostrate 2 long prostrations, with a sitting in between them, without lengthening this sitting ⭐️ You have now completed one raka’ah 1️⃣1️⃣ You repeat the first raka’ah (which consisted of 2 ruku’) 1️⃣2️⃣ End the Salah Notes: 📝 You may increase from 2 ruku’ per raka’ah to up to 5, as mentioned by al-Buhuti. One should not exceed 5 ruku’ 📝 Shaykh ibn Uthaymeen mentions, if the time of the eclipse is short, you should shorten each raka’ah to 2 ruku’. If the time of the eclipse is long, you should lengthen the number of ruku’ in accordance to the length of the eclipse. 📝 Entering the jama’ah after the first bowing does not invalidate your salah 📚 فيض الجليل
